General contract and travel conditions for GPC International Company Limited
Effective from January 1st 2016

1. These general contract and travel conditions regulate the legal relationship between you, our valued customer, and the GPC International Company Ltd. (GPC Ltd.) for travel arrangements offered and/or organized through GPC Ltd.

2. Booking Conditions

2.1 Bookings

Each booking needs to be made via mail, either postal or electronic. Please include your name, date of the cruise, the number of places reserved, the names of the passengers (as written in passport) and any special requests.

To receive confirmation of your booking please follow the payment conditions of clause 4 ff. We reserve the right to consider the contract cancelled (as per our cancellations conditions of clause 5 ff.) if any payment is late.

3. Services

3.1 Our services are based on the service description in our travel brochures, our website and travel agent advertisements. Special requests are subject to contract regulations only if acknowledged by your booking agency and documented in writing without reservation. If not otherwise stated, the services of GPC Ltd. will begin at the port of embarkation. You are responsible for the journey to these places and your punctual arrival.

3.2 Inclusions

- Transfers from and to the airport or hotel in the location of embarkation to and from MV Samambaia

- Accommodation on board in double or twin bed. Cabin with ensuite shower, toilet and AC.

- Full board including all drinks (including soft drinks, esspresso, beer) on board (excluding wine and spirits)

- Up to four dives per day (no diving on embarkation and disembarkation day) accompanied by qualified dive guides. Missed dives do not result in a reimbursement claim.

- Nitrox fillings for certified enriched air nitrox divers (courses available on request and subject to charge)

- Weights and weight belts

- Multilingual cruise director on board

- All offered excursions

3.3 Exclusions

- Pre or post cruise hotels and flights

- Cost for excess luggage (domestic and international flights)

- National marine park fees (Price may change following the regulation of the local government)

- Fuel surcharges and harbour fees ( Price may change following the government & market price)

- Long distance cruise fuel surcharge

- Dive rental gear

- 15 liter scuba tank

- Dive courses

- Dive and travel insurance (we recommend: DAN & www.travelguard.com)

- Crew gratuities (we recommend US$ 20 per day per guest)

- On-board massage

- Wine & spirits

4. Prices and terms of payment

4.1 Prices

Prices for trip arrangements are based on the price list of the GPC Ltd. Prices for trip arrangements, if not otherwise stated in the advertisements, apply per person in USD per cabin with a double or twin bed. Prices apply as per time of booking.

4.2 Deposit and payment of balance for individual bookings

To receive confirmation of a booking a deposit equal to 20% of the price of requested voyage has to be paid to GPC Ltd. or your agent no later than ten days after receiving the invoice. The balance of the voyage price must be paid to GPC Ltd. or your agent at least 90 days before the departure date. In the case where a reservation is made less than 90 days before the departure date, the total voyage price must be paid at the time of reservation. If payments are not made in the time frames required, GPC Ltd. reserves the right to refuse the services contracted and to enforce the cancellation policy mentioned in clause 5 ff. of these conditions.

4.3 Deposit and payment of balance for part or full charters

For part and full charter reservations a second pre-payment of 30% of the total price is to be paid 180 days before the date of departure. The payment of the remaining booking price has to take place no later than 90 days before the date of departure.

5. Cancellation policy

5.1 Cancellation of an individual booking

For cancellations before departure of travel, the following cancellation charges apply:

- More than 90 days prior to departure: 20% of total invoice cost

- 89 to 60 days prior to departure: 50% of total invoice cost

- 59 to 0 days prior to departure or non-appearance on departure day: 100% of total invoice cost

Changing of a cruise date is treated as a cancellation and a new booking and results in the applicable cancellations fees mentioned above.

5.2 Cancellation of a part or full charters

For cancellations before departure of travel, the following cancellation charges apply:

- more than 180 days prior to departure: 20% of total invoice cost

- 180 to 91 days prior to departure: 50% of total invoice cost

- 90 to 0 days prior to departure or non-appearance on departure day: 100% of total invoice cost

5.3 Substitute Passenger

If for any particular reason a passenger cannot travel for the cruise reserved, the reservation may be transferred to another person. GPC Ltd. must to be informed in writing three days prior of the voyage, including the reason, and be supplied all information on the replacement passenger. The new passenger must respect all conditions of the contract and GPC Ltd. cannot in any way be held responsible for any expenses or changes outside of the cruise (Hotels, flights etc.).

A handling fee of 250,- USD per person applies in such case.

5.4 Cruise cancellation or changes of itinerary by GPC Ltd.

5.4.1 Cancellations for reasons caused by the customer

GPC Ltd. reserves the right to cancel a booking if actions on the customer´s part give justifiable cause to do so. In such instance GPC Ltd. will refund any payments already made. Any further claims against ADT Inc. are excluded. Cancellation costs as stipulated in section 5.1 will be paid by the customer.

5.4.2 Minimum number of customers

For all cruises offered by GPC Ltd. a minimum of 4 participating customers is necessary. In case a minimum number of customers can not be reached GPC Ltd. reserves the right to cancel the trip up to a maximum 3 weeks prior to the departure date. In this case an alternative program will be proposed. If this is not possible, or you decide to decline the proposal, GPC Ltd. will reimburse all payments made up until that date. Any form of additional compensation will not be allowed.

5.4.3 Force Majeure and unpredictable acts of man.

GPC Ltd. reserves the right to cancel a trip due to Force Majeure (i.e. natural disasters, epidemics etc.) or unavoidable acts of man (i.e. war, riots, strikes etc.) that would seriously hamper a successful trip or endanger customer safety. In the event of this happening the GPC Ltd. will advise you at the earliest possible date.

5.4.4 Trip cancellations due to other reasons by GPC Ltd.

GPC Ltd. reserves the right to cancel a trip for other reasons that are unavoidable and will inform the customer at the earliest possible date.

5.4.5 Changes to itinerary and services

In case a major change to the itinerary does occur that drastically impinges on the prearranged itinerary (i.e. due to weather conditions etc.) GPC Ltd. will provide monetary compensation (the difference between agreed price for cruise versus outstanding services).

5.5 Trip cancellation insurance

GPC Ltd. strongly advices to subscribe to supplementary insurance coverage for cancellation. Furthermore GPC Ltd. also strongly recommends to other insurances, such as: luggage insurance, travel medical and dive insurance, medical emergency evacuation insurance etc.

6. Disabilities

The passenger must declare at the time of reservation that they do not suffer from any mental, physical, or other, disability that may put them, or other passengers at risk. GPC Ltd. reserves the right to refuse the contracted services to a passenger presenting these risks during a charter.

7. Damages resulting from personal injury, illness or death

Damages resulting from illness, personal injuries or death which may be sustained by reason of, or while engaged on, any trip whether due to the ownership, maintenance, use, operation or control of any aircraft, helicopter, automobile, bicycle, boat, vehicle, hotel, common carrier or any other conveyance used in carrying out these trips. GPC Ltd. assumes no liability due to any cause whatsoever whether caused by failure or delay or other irregularity, acts or omissions occurring during a trip under which the means of transportation or other service provided thereby is offered or supplied by owners, operators or public carriers for and on behalf of GPC Ltd.

GPC Ltd. shall not be responsible for any injury to person (whether or not resulting in death) or damage to property arising out of any act of war, insurrection, revolt or other civil uprising or military action occurring in the countries of origin, destination or passage. In case of a medical problem arising during the voyage, either on board or on shore, which results in costs for evacuation, use of aircraft or repatriation, the responsibility for payment of these costs belongs solely to the passenger.
